1. About join88mates
join88mates.com is the employer side of 88mates, run by Simon Marion, trading as 88mates, a sole trader registered in Malta (see the legal notice). It lets Australian businesses post jobs and find Working Holiday Makers (subclass 417 and 462 visas) who use the 88mates app.
By posting a job, browsing backpacker profiles or contacting a backpacker, you accept these terms on behalf of your business.
2. Who can use it
You must be authorised to recruit for the business you represent and provide accurate information, including a valid ABN. We check ABNs with the Australian Business Register and may refuse or remove access if details are wrong or cannot be verified.
3. Job posts
Job posts must describe a real vacancy, with accurate pay, location, hours and conditions. Pay and conditions must comply with Australian law, including the Fair Work Act 2009 and the applicable award or minimum wage.
You must not ask workers for any payment to get or keep a job, offer illegal unpaid work, or discriminate against candidates. We may edit, hide or remove any post that breaks these rules or looks misleading, without notice.
4. Backpacker profiles
Backpacker profiles are shared to help them find work. You may only use them to recruit for your own business.
You must not copy, scrape, export, sell or share profiles, or use them for marketing. Contact backpackers only through the contact request on join88mates; if a backpacker declines or does not reply, do not contact them by other means.
Any personal information you receive must be handled in line with the Australian Privacy Act 1988 and deleted once it is no longer needed for hiring.
5. Price and payment
Posting jobs and browsing profiles is free. If 88mates helped you hire, you can make a voluntary "pay what you want" contribution by card through Stripe, in Australian dollars. It is never required to use the service.
Contributions are processed by Stripe; we never receive your card details. As they are voluntary, contributions are not refundable, except where the law requires it. Stripe can email you a receipt; for a tax invoice, contact us.
6. Our role
88mates is not an employer, recruitment agency or labour hire provider, and is not a party to any employment relationship. We do not guarantee that you will find candidates, or that the information backpackers provide is accurate. You are responsible for your hiring decisions, including checking each worker's visa and work rights (for example through VEVO).
7. Liability
The service is provided "as is". To the extent permitted by law, 88mates is not liable for indirect or consequential loss, or for losses arising from job posts, hiring decisions or the conduct of backpackers or employers.
Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law.
8. Suspension
We may remove job posts or block access to the platform if these terms are breached, or to protect backpackers. You can remove your job post at any time using the link in your confirmation email.
9. Privacy
We process your business and contact details as described in the "Employers and join88mates.com" section of our privacy policy.
10. Changes and governing law
We may update these terms; the date below shows the latest version. These terms are governed by the laws of Malta, without prejudice to rights that cannot be excluded under Australian law.
